 マッカーサー書簡（一部新字体化、不明文字あり） 一九四八年七月二十二日ダグラス・マツカーサー 内閣総理大臣　宛 　余は、目下日本の公務員制度に関して起つている諸問題の解決策としての国家公務員法の適否に付いて、日本政府並に本司令部の代表者間に行はれた合同討議から得られた結論の検討を了した。余は、是正せらる可き現存の欠点に関する右結論には全般的に賛成である。 　国家公務員法の狙いは、日本の政府に民主的且能率的な公務員制度の樹立を規定するに在つた。本計画は近代的な人事制度を定めて、公務員を全民衆の中から、競争試験に依て、取入れることにし、又職階、報酬、訓練、考査、健康、安全、厚生、休養並に関する科学的管理の下に、 実力に基いて■進せしめることを定めた。本制度は被■者の為に不服を申立てる手続を定め、且行政機構に於ける彼等の正当にして公正な待遇を心障している。司法的行政機関に依て実行され、且緊急事態の必要に応じて直ちに改革出來得る様な緊急条項を附加された、本制度は日本に於ける民主主義の成功を阻んだ旧官僚制度の種々の宿弊を是正すに足る建設的計画を定めている。 　今次創設された人事行政の基調は全国民が国会を通じて政府の使用人に対して主権と監督権を行使し、其の国会が人事委員会を通じて科学的人事行政の原理を適用し、且公務員制度、公務員の充足、報酬、■紀、年金及雇用に伴う其の他の条件を標準化すると云ふ考へ方に立つているのである。民主主義の考へ方に基く斯る制度は、法律の忠実な実施と政府へ仕事の能率的運営とを最高の職責として、政治や特権の圧迫に屈しない意図の下に作られたものである。 　本問題に関係のある色々な法規の研究は今や完了したのであるが、情勢に対処する為にはこのまゝでは不十分であることが明となつた。これ等の法規は小数者が団結して政府の権限と権威に加える圧力に突し積極的な保護を与えるものではなく又公務員制定の恩恵と保護を受け又制限に服する義務を有する政府職員の各種職階に対して法規の適用が明かになつていない。全体にわたつて政府に於ける職員関係と、私企業に於ける労働者関係の区別が著しく明確を欠いている。 　占領下日本に於いて労働者が、急速に且つ前例のない地歩を獲得した事実は、現代生活に於て労働組合主義が極めて重要なものであることと現代の産業軽罪に伴う多くの幣害を最正するに当り労働...
